Welcome to this website, or mobile site https://ecotravelboutique.com/. Please review the below terms and conditions carefully before using the website or using our products / services. These terms and conditions, which may be modified from time to time, apply to all visitors and/or users of this website / mobile site / and to anyone purchasing The Eco-Travel Boutique products or services.

 

mnThe purpose of these terms and conditions is to protect both you and us – and to clarify our offerings in order to avoid any misunderstandings. If anything is unclear, please email us on  info@ecotravelboutique.com.com and we will be happy to answer any questions for you!

 

By using our website and services, you agree to the following terms and conditions between The Eco-Travel Boutique (Pty) Ltd 2021/649288/07 and yourself: 

 

1.     Agreement

a.      By using our website and / or accepting our travel services you acknowledge that you are 18 years of age or older and that you understand and have the legal capacity (and authority) to enter into this contract and transact with us and agree with the Terms and Conditions below, on behalf of yourself and those that accompany you (e.g. the “Attendees”). It is your responsibility to bring these terms and conditions to the attention of the payer and all Attendees, and it will apply to our relationship with you and them (hereinafter collectively called “the Client” or “you” or “your”).

2.     Information and pricing on the website

a.      The Eco-Travel Boutique takes the greatest care in providing accurate and up to date information on its website and in client communication. All the website texts such as descriptions, information, images, and other details regarding travel and consultancy services are checked on a regular basis. The Eco-Travel Boutique can however not be held responsible for any incorrect information, including but not limited to supplier changes, upgrades, typing errors and outdated information.

b.      All supplier pricing on the website (excluding prices of consultancy services and products in the web shop) are approximate and subject to availability and confirmation by the supplier at the time of booking. Pricing of the accommodations and travel packages on the website are ‘FROM’ Prices, based on entry level room types in the low season. Prices are shown as nightly ‘per person sharing’ rates, except where mentioned otherwise 

 3. Booking Terms and Conditions 

  1. The Company will design a full travel package (Excluding flights) for the client and confirm bookings with third party suppliers on behalf of the client 
  2. A Deposit is required in order to confirm the bookings, after which the client will provide The Company with all requested information pertaining to the booking 
  3. Once the balance payment has been received by The Company, The Eco-Travel Boutique will update the client’s (digital) itinerary to reflect all the required information 
  4. It is the responsibility of the Client to ensure correct booking details (Names as per passport, travel dates, etc.) and timely payments are provided in order to avoid cancellation. The Company will not accept responsibility for any loss, damages, delays or cancellations occasioned by incorrect information supplied by you, or recorded in any invoice, unless the reservations provided to you upon arrival differs from that which you have provided 
  5. ALL CHANGES AND CANCELLATIONS TO YOUR BOOKINGS MUST BE MADE IN WRITING AND ARE SUBJECT TO THE COMPANY’S AND LOCAL SUPPLIER’S TERMS & CONDITIONS AND THEIR CANCELLATION POLICY 
  6. Should a refund be due to you in terms of any law, funds are refunded by the supplier based on their decision and instructions 

4. Payment Policy 

  1. We accept payments through PayPal.com, an online payment processor, which accepts credit and debit cards. Alternatively, you may make payment through direct EFT (Electronic Funds Transfer) to our Bank account held at FNB (First National Bank), South Africa (Details available on request) 
  2. Booking via a Travel Platform requires payment on the relevant platform
  3. Deposit is required in order to confirm a bookings. The deposit is generally 30% of the total booking value, however a higher % can apply based on local supplier’s term
  4. The balance amount is required 60 days before the first arrival date in the destination 
  5. A payment is only confirmed and secured once we have received the funds (i.e. full payment has cleared) in our bank account, subject to the terms of the rest of this agreement. Should any discount be applied, the discount is realized upon the full and final payment 
  6. Any payments to third party suppliers quotations will be subject to the terms set out therein, and exclude all items, services and charges not specifically listed in the quote 
  7. The Eco-Travel Boutique will not be liable for any payments not being made on time which may result in the loss of the reservation 

5. Cancellation Policy

  1. The deposit amount is a non-refundable payment. Date changes can be made to an itinerary subject to the booked suppliers’ terms & conditions 
  2. A 100% Cancellation fee applies from 60 days before travel. Date changes can be made to an itinerary subject to the booked suppliers’ terms & conditions 
  3. Any supplier terms & Conditions that are stricter than our general terms will override the above. (E.g. if a supplier requires a 50% non-refundable deposit, this will be charged to the client on cancellation)
  1. Traveler Responsibility

a.      All travelers (the attendees) within a party shall be responsible for taking out and maintaining comprehensive travel, personal, health and general insurance in amounts sufficient to adequately cover all risks (including amongst others Force Majeure Events) and to compensate for any loss, damage to, or destruction of any property, or the death or injury of any person, and the attendees indemnify The Eco-Travel Boutique and any third party suppliers against any liability in this regard 

b.     The traveler(s) shall ensure that all the relevant documents, agreements and indemnity forms sent to them for signing have been read, comprehended, signed and returned to The Eco-Travel Boutique in a timely manner. Failure to do so may result in cancellation of your bookings by the relevant suppliers

c.      The traveler(s) shall ensure that they have the correct travel documents and meet all the visa and health requirements and that these documents are valid throughout the period of your Booked trip. These documents include (without limitation) visa’s, passports, medical and inoculation documents, and drivers’ licenses. 

Valid passports which will not expire for at least 6 months after the return date are required. If you are unsure of any requirements, you are advised to contact the consulate/embassy concerned. 

Please note that anyone travelling to Southern Africa must have two consecutive blank pages in their passport, which lie side by side when the passport is open (i.e. a left and a right-hand page). Attendees travelling to Southern Africa with passports which do not comply with these requirements will either be stopped from boarding the aircraft or risk deportation on arrival in Southern Africa.

d.     The traveler(s) shall acknowledge an awareness of the proposed itinerary and confirm that they are medically fit, in good physical and mental health and that there is nothing which renders him/her unfit to undertake the Tour

e.     The traveler(s) shall be responsible for ensuring any required vaccinations and other necessary precautions have been obtained before the starting date of the tour

f.      The traveler(s) shall be responsible for ensuring that they will carry sufficient prescribed and chronic medication with them at all times for the duration of the Tour and for at least one additional week. The Traveler(s) understands that it is their responsibility to ascertain whether their medication may be considered a prohibited substance by the country/countries that he/she is visiting. 

 

  1. Data and Privacy 
    1. The Client warrants that the personal details of Client and all Attendees provided, are up to date and true and correct and undertake to inform The Eco-Travel Boutique, as well as any third party suppliers immediately of any changes
    2. By using our Website and/or contacting us, you, the Client, and on behalf of all Attendees hereby consent that your personal information (which shall include, amongst others, a person’s name, contact and personal details, and possibly medical details, passport numbers, bank card details and the like) may be retained and used for the purpose of corresponding with the Client/Attendees, record keeping, billing, and liaising with our Suppliers/third parties to quote on their products/services and communicate products/services (advertising) to you, or to facilitate delivery of the services contemplated herein (including any person or company involved in your Booking and their staff/officers), including disclosing such information to our bankers & insurers, or your bankers/credit or debit card issuer, the Financial Intelligence Centre or persons responsible for our accounts (collectively hereinafter referred to as the “Team”)
    3. The Client / Attendees hereby declare that they understand that The Eco-Travel Boutique will not divulge any personal information to a third party (other than disclosed herein) unless required by law, and furthermore consent to The Eco-Travel Boutique contacting the Client using the details provided by them, and agree to ensure that this consent which is hereby given is brought to the attention of each Attendee. 

You confirm that you understand that you have the right to stipulate that certain information must be withheld from the Team, and agree to do so in writing addressed to the following email: info@ecotravelboutique.com.com

You also agree and understand that where The Eco-Travel Boutique provided third parties with your personal information we do not have control over the management and utilization of that personal information, and you accordingly indemnify and hold The Eco-Travel Boutique and its officers and employees harmless against any damages or losses of whatsoever nature (including penalties and/or fines and legal costs on the scale of attorney and own client) suffered by you or us as a result of a breach by any third parties of their obligations under the Protection of Personal Information Act. You further agree to the transfer of our personal information cross-border if required and accept that we will endeavor that the same level of protection is afforded to such information as that processed in SA

 

    1. When you forward personal information including your name, e-mail address, mailing address, passport and credit card details to us, we will use a secure server to encrypt such information before it is received by us
    2. Our website may use “cookies” to customize it and make your visit to us more user-friendly. Cookies cannot harm your computer in any way and are an industry standard. They are small text files that contain only information provided by you, the visitor, to the website. Furthermore, you may configure your browsers to not accept our cookies. By providing us with your personal information you agree that we may use and store such information you have provided to us, and send you e-mail messages with news and special offers from our Suppliers. You may at any time elect not to receive such emails by clicking unsubscribe in the email footer or sending an email to this effect to us at: info@ecotravelboutique.com.com

f.       The Client agrees that telephone calls may be recorded for quality control and to maintain our service standards. The Client hereby agrees that any content generated by the Client or any website user on the website, e.g. in reviews or ratings, can be used by The Eco-Travel Boutique or by any third party with our consent and to the extent necessary, the user irrevocably licenses such content to us in perpetuity, at no fee and waives any rights to such content

g.      Some of our accommodation suppliers may reserve the right to take photographs and videos of guests during their time in the accommodations within the destination and/or whilst on Activities and to reuse such material for promotional and other purposes. The camp management must be notified at the time of signing the Indemnity, Waiver, Disclaimer and COVID-19 form should the guest not wish their images to be published. 

 

 

  1. Website Security

a.      The Eco-Travel Boutique uses SSL (Secure Sockets Layer) when transacting with our client’s confidential data on the internet. SSL is sophisticated security technology for establishing an encrypted link between a web server and a browser. This link ensures that data passed between the web server and browsers remain private and integral. SSL is an industry standard and is used by millions of websites in the protection of their online transactions with their customers, and you hereby agree to the use of SSL as a sufficient security layer in our dealings with you

 

  1. Disclaimer

a.      The Eco-Travel Boutique, as an agent/intermediary of Suppliers does not have control over the executions of any travel arrangements, which is why it is important that the Client understands that all arrangements for amongst others, activities, functions, entertainment, transportation, conveyance and/or accommodation, are made upon the express condition that Eco-Travel shall not be liable for any injury, death, damage, loss, accident, delay or irregularity which may be occasioned either by reason of the liquidation, sequestration (whether provisional or final), or any defect in, or through the acts or defaults of any of the suppliers, their personel or agents engaged in the provision of the booking or in carrying out the arrangements for the booking or otherwise in connection therewith. 

b.     In addition, we will not be liable for loss or damage caused by the client or its attendees to any person, property, or thing. The cient and attendees voluntarily accept the risk associated with their booking. 

 

  1. Suppliers

a.      Whilst we take the greatest care in vetting Suppliers, The Eco-Travel Boutique is not liable for the suitability of the Suppliers the Client selected, or their products or services. We do not guarantee the suitability, products or services of Suppliers, nor take responsibility for any disputes between a Client (and/or Attendee) and their Supplier

 

  1. Applicable Law, Costs
    1. This website is created, maintained and controlled in South Africa and as such, the laws of SA and the jurisdiction of the SA Courts govern the use of the Website, as well as the use or inability to use this website, and any bookings

b.     The Eco-Travel Boutique shall be entitled to recover all legal costs on the highest scale permissible in law should it elect to obtain legal opinion or institute or defend legal action against the Client/Attendee

 

  1. Change to Agreement

a.      The Eco-Travel Boutique reserves the right to make changes to this site and these terms and conditions at any time without notice, and you agree that such changes will apply to you and any new bookings you make after these changes have been published on our Website

 

  1. General
    1. This agreement, together with the schedules/annexures hereto, constitutes the sole record of the agreement between the parties in regard to the subject matter thereof
    2. No addition to, variation, or agreed cancellation of this agreement or any of the appendices (Supplier terms and conditions amongst others) hereto shall be of any force or effect unless in writing and signed by or on behalf of the parties in a non- electronic format
    3. The grant of any indulgence, extension of time or relaxation of any provision by The Eco-Travel Boutique (“Grantor”) under this Agreement shall not constitute a waiver of any right by the Grantor or prevent or adversely affect the exercise by the Grantor of any existing or future right of the Grantor
